Using listings to make telephone calls

  1. If you use listings on this site to make telephone calls or to send other communications (eg, SMS messages), you may be liable to pay charges to the applicable service provider. If you use Telstra as your service provider, you will pay charges to Telstra.
  2. Telstra advises:
    1. When 13 or 1800 numbers are called from mobile telephones, applicable mobile call charges will apply.
    2. Calls to 0055 or 1900 numbers are charged according to the duration of the call, the time of day and the type of service. Higher rates apply to calls made from public and mobile telephones.
    3. Calls to 1800 FREECALL™ numbers are free from a fixed Telstra service, but other service providers may apply charges. For call charge information please contact your service provider.

Our liability to you

  1. The terms that apply to our supply of this site and the Site Content are those that are set out in the documents that make up the Terms (as listed above) and those implied by consumer protection laws to the supply of this service that are unable to be excluded. No other terms apply.
  2. We accept our liability to you for breach of contract or negligence under the principles applied by the courts, but:
    1. we do not accept liability to you for losses that result from your use of our products and services in connection with the conduct of a business. However, we will accept that liability if it cannot be excluded under any legislation. If that liability cannot be excluded but can be limited under any legislation, we limit our liability to re-supplying, repairing or replacing the relevant products or services (or payment of the cost of re-supply, repair or replacement) where it is fair and reasonable to do so;
    2. we are not liable for any loss to the extent that it is caused by you (for example, through your negligence or breach of contract);
    3. we are not liable for any loss to the extent that it results from your failure to take reasonable steps to avoid or minimise your loss; and
    4. we are not liable for any loss caused by us failing to comply with our obligations to you where that loss is caused by events outside our reasonable control (such as a malfunction in equipment or software, Internet access difficulties or delay or failure of transmission).

Your liability to us

  1. You are liable to us for breach of contract or negligence under the principles applied by the courts. However, you are not liable to us for any loss to the extent that it is caused by us (for example through our negligence or breach of contract).

Termination, suspension and limitation of your access - material breach by you

  1. We may suspend, terminate or limit your access to this site at any time if you are in material breach of these Terms and:
    1. we have told you in writing of your breach and you have failed to remedy it within 14 days of us telling you; or
    2. the breach is something which cannot be remedied (in which case we can cancel the service immediately by telling you).

Our other rights to terminate, suspend or limit your access

  1. We may suspend, terminate or limit your access to this site with as much warning as we reasonably can, if:
    1. we reasonably believe that there is a real risk of loss or damage to us or another if we do not suspend, terminate or limit your access to this site;
    2. the law requires us to do so;
    3. we believe on reasonable grounds that providing you with access to this site or to the Site Content is illegal or may become illegal; or
    4. there is an emergency.

General

  1. We and you are independent contractors and no agency, partnership, joint venture or employment relationship is intended or created by these Terms.

Severability

  1. If any of these Terms are invalid, unenforceable or illegal, that term will be struck out and the remaining terms will remain in force.

No waiver

  1. If we do not act in relation to a particular breach by you of these Terms, this will not be treated as a waiver by us of our right to act with respect to subsequent or similar breaches. Governing Law

  1. These Terms (and your dealings with us) are subject to the laws of Victoria, Australia.
